The Law of DUI Under the Influence of Drugs

You can be charged with even the tiniest trace of illegal narcotics in your system. Unfortunately, if the substance is a legal, prescribed medication, you could be charged with even the precisely directed amount in your system. The amount is not relevant like it is for alcohol-related charges; any amount that impairs your ability to drive could result in charges.

Because these charges are becoming more and more common, there are several angles of attack against them. These include checking for:

Legal levels of prescribed medications: drug-related DUI charges commonly result when people take prescribed amounts of pain prescriptions and anti-anxiety medications like Xanax, Oxycontin, Vicodin, Valium and Percocet. The fact that the medication was taken as prescribed could prove to be a valid defense.

Side-effects of prescribed medications: Often charges arise because of unforeseen side-effects of legally prescribed medications, like sleepiness, dizziness, and headaches. Ambien, for example, has been known to cause sleepwalking and even driving while totally asleep. If the drug was legally prescribed, and the dose was within normal range, the charges could be challenged.

Incorrect testing results for illicit drugs: Though these drugs are illegal, amounts of them in your system might not be sufficient to impair your ability to drive. THC, the active ingredient in marijuana, has a very long half-life and can linger in your system for long after you have ingested it, possibly leading to inaccurate results.
